Constitution of Joint Consultative Negotiating Committee
Title
The Committee shall be known as the Bath Spa University Joint Consultative and Negotiating Committee (hereinafter referred to as 'the JCNC').
Area
The sphere of operation shall be Bath Spa University.
Functions
The JCNC comprises two common interest groups as agreed in the Recognition and Procedure Agreement. Their functions shall relate to those groups of staff indicated in the Recognition and Procedure Agreement, ie:
UNISON - Management, specialist, administrative, operational and technical
UCU - Academic staff
Membership
The JCNC shall consist of 12 members of whom 6 shall be appointed to represent the Employers, and 6 to represent the employees.
The employers' representatives shall be four members of Vice-Chancellor's Group plus the Director of Human Resources plus one other member nominated by the Vice-Chancellor.
The employees' representatives shall be as agreed in the Recognition and Procedure agreement
Failure to appoint the full number of representatives as shown above shall not vitiate the decisions of the JCNC.
Where a member of the JCNC is unable to attend any meeting of the JCNC a substitute member may be appointed to attend from among existing members of his/her group.
Trade Union Officers may attend as ex officio members of the Committee. The JCNC may also invite any persons of special knowledge, not being members of the JCNC to attend meetings to serve the special purpose of the JCNC provided that they attend only in a consultative capacity. Such invitation must be a unanimous decision of the JCNC.
Conduct of business
The JCNC will meet as agreed in the Recognition and Procedure Agreement.
Notices of meetings will be sent to members at least 7 days before the date of the meeting.
Extraordinary meetings may be called by the Chair or the Secretaries of either side. There must be at least 10 working days notice of such meetings.
The JCNC will be presided over by a Chairperson to be appointed from among members and to hold office for one year. The Chair may be held in alternate years by a member of the Employer's side or a member of the employees' side. The Chairperson shall have a vote. In the absence of the Chairperson a Chair for the day shall be appointed from either side.
Each side shall appoint a secretary from both the Employer's and the Employee's sides. Their duties will include arranging meetings, compilation of a joint agenda and joint minutes for the Committee's approval.
No resolution shall be considered carried unless supported by a majority of both sides.
